A group of 61 Tamil asylum seekers from Sri Lanka, which includes 16 children, has resided on Diego Garcia, the biggest island in the Indian Ocean, since October 2021 following their rescue at sea by members of the Royal Navy.
In March, several migrants initiated a lawsuit against the Foreign Office, alleging that there was an "illegal delay" in organizing their transfer to a secure third country.
Previously, it was reported to the High Court in London that individuals on the island experienced conditions described as "inhumane," including issues with overcrowding and rat infestations.
In a communication dated Monday, legal representatives for the Foreign Office and the Home Office indicated a potential shift in policy. This change would enable families, children, and single men without criminal records or pending investigations to be directly relocated to the UK.
"The letter also noted that a resolution regarding allowing entry into the UK in this manner should be made within the next 48 hours, at which point further information will be shared."
Leigh Day, a law firm, reported that the migrants were residing "in tents within a secured and monitored enclosure, under such dreadful conditions that there have been multiple incidents of suicide attempts and self-harm."
The Chagos Archipelago belongs to the British Indian Ocean Territory (BIOT).
Leigh Day reported that BIOT Commissioner Paul Candler described the camp conditions as "perilous and unmanageable," noting that children were especially experiencing "direct and continuous harm."
A member of the commissioner’s healthcare staff on the island referred to the camp as being "in total disarray," according to the law firm.

Tom Short, a solicitor from Leigh Day, stated: "Our clients, who number 16 children, are pleased with the home secretary's overdue decision to provide them safety in the UK.
"Our patrons escaped Sri Lanka to avoid persecution. Their subsequent treatment and wrongful imprisonment by the British Indian Ocean Territory Administration over the last three years is appalling.
"Today's ruling brings immense comfort to our clients, and we implore the home secretary to shut down the camp and transfer our clients here immediately so they can start their healing process."

Members of the European Parliament are set to vote on the entire team of Commissioners through a roll-call vote, which requires a majority of the votes cast. This election is planned to occur in the plenary session in Strasbourg from November 25 to 28.
