OpenAI’s Whisper: The Transcription Tool Hospitals Use Despite Its Tendency to Invent Dialogue

Saturday's Associated Press probe uncovered that OpenAI's Whisper, a transcription tool, generates false text in medical and business environments, even though its application in these areas has been cautioned against. The investigation involved discussions with over a dozen individuals, including software engineers, developers, and researchers, who observed that the model frequently produces text not originally spoken by users, an issue commonly referred to as "confabulation" or "hallucination" within the AI community.
OpenAI announced in 2022 that its Whisper technology neared "human-like precision" in converting speech to text. Yet, a University of Michigan scholar shared with the AP that in their analysis, Whisper inaccurately generated text in 80% of the public meeting records reviewed. Additionally, a developer, who remained anonymous in the AP story, reported encountering fabricated content in nearly all of their 26,000 transcription tests.
Misrepresentations present specific dangers within medical environments. Ignoring OpenAI's advisories to avoid deploying Whisper in "high-stakes areas," an AP report indicates that more than 30,000 healthcare professionals have adopted Whisper-dependent applications for documenting patient consultations. Among the 40 healthcare institutions utilizing a Whisper-enhanced AI assistant service from healthcare technology firm Nabla, which is specially adjusted for medical vocabulary, are the Mankato Clinic in Minnesota and the Children’s Hospital Los Angeles.

Nabla recognizes that Whisper has the ability to fabricate conversations, yet it also purportedly deletes the initial audio files "for reasons related to data protection." This deletion could lead to further complications, as medical professionals are unable to check the transcripts' reliability against the original recordings. Moreover, patients with hearing impairments might be significantly affected by erroneous transcripts, given they have no method to ascertain the accuracy of the medical audio transcriptions.
Concerns surrounding Whisper reach outside the realm of health care. A study conducted by scholars from Cornell University and the University of Virginia, which analyzed thousands of audio clips, revealed that Whisper was inserting violent and racially charged content into otherwise neutral speech. The researchers discovered that 1 percent of the audio samples contained completely fabricated phrases or sentences that were not present in the original recordings. Moreover, 38 percent of these fabrications involved serious issues like promoting violence, creating false connections, or suggesting unfounded authority.
In an instance mentioned in the research referred to by AP, a scenario involved a speaker mentioning “two other girls and one lady,” wherein Whisper introduced made-up details claiming they “were Black.” Furthermore, in a different situation, the original audio stated, “He, the boy, was going to, I’m not sure exactly, take the umbrella.” However, Whisper altered the transcription to, “He took a big piece of a cross, a teeny, small piece … I’m sure he didn’t have a terror knife so he killed a number of people.”
A spokesperson from OpenAI conveyed to the Associated Press that the organization values the insights from the researchers and is diligently working on minimizing inaccuracies. They also mentioned that such feedback is instrumental in refining the model through updates.
The Reason Behind Whisper's Fabrications
The reason Whisper is not reliable in critical areas is due to its tendency to occasionally fabricate, or convincingly produce, false results. Contrary to the AP report's claim that "It's unclear why Whisper and akin technologies generate these false outputs," the reality is quite the opposite. The behavior of Transformer-based AI systems, including Whisper, in generating such inaccuracies is well understood.
Whisper utilizes a form of technology aimed at forecasting the upcoming token (data segment) expected to follow a series of tokens inputted by a user. For ChatGPT, these initial tokens are derived from a textual prompt. Conversely, Whisper processes tokens that are derived from audio data that has been tokenized.
The output generated by Whisper represents its best guess rather than a guarantee of correctness. The dependability of results from Transformer-based systems like Whisper generally correlates with how much precise, related data was included during training, though accuracy is not assured. In instances where Whisper lacks sufficient context within its neural network to accurately decipher a specific piece of audio, it will resort to relying on its understanding of the sound-word associations it has assimilated during its training period.
In 2022, OpenAI disclosed that Whisper was trained on "680,000 hours of diverse, supervised data from various languages and tasks found online." However, further insights have been revealed about its data sources. Observations of Whisper frequently generating phrases such as "thank you for watching," "like and subscribe," or "drop a comment in the section below" in response to silent or unclear inputs suggest that OpenAI might have used a vast amount of captioned audio content from YouTube videos for training. The necessity for audio that comes with corresponding captions for the training process of the model supports this theory.
Another concept known as "overfitting" exists in AI systems, where data (here, text from audio transcriptions) that appears more often in the training set is more likely to be generated in the results. When Whisper faces low-quality audio in medical records, the AI model generates what its neural network deems to be the most probable response, even if it's wrong. For any given YouTube video, the most common output is "thanks for watching," simply because it's a phrase that's frequently used.
In some instances, Whisper appears to utilize the surrounding conversation context to predict subsequent content, which can present issues due to its training data possibly containing prejudiced remarks or incorrect health-related facts. For instance, if the training dataset predominantly contains instances where the phrase “crimes by Black criminals” is used, then when Whisper processes an audio clip with “crimes by [unclear audio] criminals,” there's a higher chance it will erroneously complete the transcription with “Black.”
In the foundational document for the Whisper model, experts from OpenAI discussed this specific occurrence, explaining, "Due to the models being developed through a loosely guided learning process with vast amounts of unrefined data, the outputs might contain elements that weren't present in the original audio input (referred to as 'hallucination'). Our theory is that this arises because the models, leveraging their broad understanding of language, blend the attempt to anticipate the upcoming word in the audio with the effort to directly transcribe the audio."
In this regard, Whisper possesses an understanding of the conversation's content and monitors the discussion's context. This capability resulted in a situation where Whisper incorrectly labeled two women as Black, despite the absence of such details in the initial audio. To mitigate such errors, it's proposed that an additional AI system, specifically trained to identify segments of ambiguous audio that might cause Whisper to make incorrect assumptions, could be employed. This system would highlight those parts of the transcript, allowing for human verification of accuracy afterwards.
Undoubtedly, OpenAI's recommendation to avoid deploying Whisper in sensitive areas like essential medical documentation was prudent. However, the healthcare industry's relentless pursuit of cost reduction often leads them to adopt AI solutions that appear to suffice, as evidenced by Epic Systems' implementation of GPT-4 for handling medical records and UnitedHealth's utilization of an imperfect AI system for making insurance-related determinations. It's quite conceivable that individuals are already experiencing adverse effects as a result of errors made by AI, and addressing these issues will probably require the introduction of regulatory measures and the certification of AI technologies employed in healthcare settings.

For more than a month now, I've been experiencing the beta version of Apple Intelligence on my iPhone 16 Pro, and honestly, my daily life hasn't seen significant changes since its introduction.
For those who haven't ventured into the public beta, today marks the day when you can firsthand try it out. Apple is rolling out its eagerly anticipated artificial intelligence capabilities in the latest updates for iOS 18.1, iPadOS 18.1, and MacOS Sequoia 15.1, which are becoming available for certain iPhones, iPads, and Mac computers.
Leveraging its advanced language processing technologies, Apple is promoting its Intelligence feature as a key selling point for the latest iPhone 16, iPad Mini, and iMac models. During the WWDC event last June, Tim Cook claimed this feature would elevate the user experience of Apple devices to unprecedented levels. However, the reality is that this experience, as it stands now, is rather lackluster.
The Initial Deployment
The introduction of Apple Intelligence marks a departure from Apple's usual approach of unveiling major updates and features all at once, often coinciding with the launch of new hardware. This time, iOS 18.1 is released a month following iOS 18 and the debut of the iPhone 16 lineup. Even after updating to iOS 18.1, users are required to sign up for a waitlist to utilize Apple Intelligence, provided their devices are compatible. Approval from the waitlist typically spans only a few hours. However, the full suite of Apple Intelligence capabilities will not be immediately available; they are slated to be introduced with the forthcoming iOS 18.2 update.
In the Writing Tools menu, you have the options to either Rewrite, Proofread, or Summarize the selected text.
What actions can you take immediately? Begin with the Writing Tools feature. It assists in Rewriting, Proofreading, or Summarizing your text across the operating system. The Rewrite option can alter the sentence's style from informal to formal, for instance, whereas Proofread corrects spelling mistakes and enhances grammatical structure. Unfortunately, it's often difficult to recall this feature's availability since it only becomes visible upon selecting text. It might be more effective if Writing Tools were integrated as a small button within the on-screen keyboard.
Now, you have the option to communicate with Siri through typing, a feature that isn't exactly brand new. This functionality was previously hidden in the accessibility settings but has now been integrated more seamlessly into the user interface, aligning Siri with competitors like Alexa and Google Assistant who have offered text input as a standard feature for quite some time. Siri also unveils a refreshed look, characterized by a subtle glowing effect around the edges of the screen, and shows improved comprehension of spoken requests, being more forgiving of speech errors. However, in practical everyday use, these updates don't significantly alter the Siri experience, which may come across as somewhat disappointing despite the visual refresh.
In other sections, there's a feature that allows you to dispatch Smart Replies—these are brief, AI-crafted responses that relate to the ongoing discussion, such as “Thank you” or “Sounds good,” to contacts via Messages and Mail. Although this functionality can prove useful, it's challenging to muster enthusiasm for an option that Gmail has incorporated since 2017.

Summarization is a key feature of Apple Intelligence, offering users a snapshot of web content and their notifications. It condenses group chat messages into essential points, allowing users to delve into the specifics by clicking through. However, I've found the summaries to be somewhat jumbled and less useful in practice.
On one occasion, it provided a summary of my work emails and mentioned "medical emergency" within it. Curious, I looked through my emails to understand the context. It appeared that an individual had apologized for replying a day late due to a medical emergency, although they assured they were okay. The email wasn't critical for my work, and I was relieved to know they were alright, but the summary prompted me to inspect my inbox unnecessarily. Often, I found myself drawn to check my notifications because Apple Intelligence pointed out details that appeared important but ultimately were not.
The primary standout capabilities of the initial release of Apple Intelligence include the Clean Up feature and the instant transcription function available in the Phone, Notes, and Voice Memo applications. Clean Up allows for the removal of unwanted elements from images, a feature first seen on Google's Pixel phones in 2021. Simply select Edit on an image, then Clean Up, and the tool proficiently eliminates the chosen item, seamlessly filling the void. Conversely, the transcription feature enables users to record in Notes, Voice Memo, or even during phone conversations, automatically saving a written copy of the audio. For someone in journalism like myself, this feature is incredibly useful.
The initial batch of Apple Intelligence features includes some of the premier real-time transcription functionalities.
Finally, there's an underappreciated gem to check out – the search feature in Apple Photos. The restrictions on searching for photos have been reduced, so entering a phrase such as “at the park with [your spouse's name]” is likely to bring up all relevant pictures for you to look through. It's capable of grasping the context of your search, provided you make use of Apple Photos' options to tag people and pets. (Interestingly, Google has also recently introduced a remarkably similar functionality in Google Photos.)
The Return of Innovation
The limited number of new features introduced in the initial update to Apple's Intelligence platform may seem familiar, having been previously offered by rival companies. However, the question of Apple's timeliness in introducing these features is overshadowed by the benefit to Apple customers, who can now utilize these functions with enhanced privacy and security through Apple's Private Cloud Compute (additional details on this technology are available here).
Apple might have been better off delaying the release of Apple Intelligence until it could offer all its major features at once, rather than rolling them out bit by bit. Siri has long suffered from a poor reputation, and while Apple Intelligence is supposed to improve this, Siri's performance in iOS 18.1 appears largely unchanged. Frequently, my inquiries are met with the standard “Here's what I found on the web.” It appears the significant upgrade, which includes ChatGPT integration for more nuanced questions and answers, won't arrive until iOS 18.2. Despite the implication that Apple Intelligence offers something fresh, the current experience falls short of that expectation.
The upcoming update is set to introduce some of the most fascinating voice capabilities. For instance, Siri will gain the ability to comprehend the context displayed on your device's screen. This means if you receive a text message with an address, you can instruct Siri to add it directly to your contact's information. Furthermore, with Siri's access to your emails and text messages, it can utilize personal context to assist you further. For example, if you inquire, "What time should I leave to collect my sister from the airport?" Siri will analyze the flight-related emails or texts from your sister and combine this information with current traffic conditions to give you a precise answer.
The capabilities that could elevate the iPhone experience to unprecedented levels are exclusively found in iOS 18.2. This version introduces Image Playground, enabling users to produce images from text descriptions through AI; Genmoji, allowing for the creation of unique emojis via text input; and Visual Intelligence, which is capable of recognizing objects in your environment and offering relevant information (such as identifying an actor from a movie poster). I anticipate that Genmoji will become incredibly popular, as the allure of designing personalized emojis is undeniable.

I recently installed the developer beta version of iOS 18.2, which was released towards the end of last week. So far, my experience has primarily been with Visual Intelligence, which I find more engaging than many other Apple Intelligence functionalities. To activate it, you simply long-press the Camera Control icon, aim your camera at an object in the real world you're curious about, and you have the option to either “Ask” via ChatGPT or “Search” using Google. Does this remind you of Google Lens, which has been around for seven years? Absolutely, but interestingly, I have found myself utilizing this feature more frequently in the last week than I have with most Apple Intelligence tools in the previous month – the convenience of a dedicated button cannot be overstated.
Just the other day, my spouse was amazed by the ongoing bloom of our neighbor's flowers. We were eager to identify the type of flower it was—she used Google Lens on her Pixel, while I accessed Visual Intelligence on my iPhone. After taking photos of the flowers, both applications essentially provided the same information—we were observing daisies, which can continue to flower into the fall with proper care and suitable weather conditions.
Regardless, if Siri's capabilities have left you wanting more, the upcoming upgrade is poised to revamp the decade-old virtual assistant, ideally making it competitive with its rivals. However, considering its track record, skepticism regarding Siri's potential to be anything beyond a source for weather updates is understandable.

AI-Generated Content Overwhelms Medium
Medium, like other prominent online posting platforms, is being inundated with content produced by artificial intelligence.
Over the years, the publishing platform, now in its twelfth year, has made numerous strategic shifts. This summer marked its first instance of achieving a monthly profit, signaling a positive turn in its financial performance. Tony Stubblebine, the CEO of Medium, along with other leaders within the organization, often refer to the service as a hub for authentic human writing. However, there are indications that the platform is also becoming a popular destination for automated bloggers.
At the start of the year, WIRED tasked artificial intelligence detection company Pangram Labs with examining Medium. They reviewed 274,466 posts from a six-week span and found that approximately 47 percent appeared to be produced by AI. "This percentage greatly exceeds what I observe across the broader internet," remarked Max Spero, CEO of Pangram. (In a separate study analyzing global news websites over a single day this summer, the firm identified about 7 percent of the content as probably created by AI.)
The quality of content on Medium often leans towards the mundane, particularly when contrasted with the surreal and random content that overwhelms Facebook. Rather than encountering bizarre concepts like Shrimp Jesus, one is more likely to stumble upon empty pieces discussing cryptocurrency. According to Pangram's analysis, among the tags most frequently associated with content that appears to be generated by artificial intelligence, "NFT" stands out. In a review of 5,712 articles tagged with this term in recent months, 4,492, or approximately 78 percent, were identified as potentially AI-created. Other tags frequently associated with AI-produced content include "web3," "ethereum," "AI," and oddly enough, "pets."
WIRED approached another firm specializing in AI detection, named Originality AI, to conduct its analysis. This firm reviewed a selection of blog posts on Medium from 2018 and compared them to posts from the current year. In the 2018 batch, they found that about 3.4 percent could be considered as possibly generated by AI. Jon Gillham, the CEO, mentioned that this figure aligns with the company's rate of false positives, indicating that AI tools were not commonly utilized at that time. In contrast, for the year 2024, out of 473 articles analyzed, they suspected that roughly 40 percent were produced by AI. Despite not sharing their findings with each other, both Originality and Pangram reached similar conclusions regarding the prevalence of AI-created content.
In response to WIRED's outreach for commentary on this piece, and after being informed about the findings from AI detection studies, Stubblebine dismissed the notion that Medium is facing a problem with AI. "I'm challenging both the significance of these findings and the notion that these entities uncovered anything noteworthy," he stated.
Stubblebine acknowledges the significant increase in AI-generated content on Medium, estimating a tenfold rise since the start of the year. He expresses a firm stance against AI-created material on the site, highlighting his opposition. However, he raises concerns about the effectiveness of AI detection tools, arguing they fail to distinguish between entirely AI-produced articles and those that use AI assistance to a lesser extent. Contrarily, Spero disputes this, asserting that Pangram is capable of differentiating between content fully generated by ChatGPT and content that starts with an AI framework but is expanded upon by human writing.
Stubblebine reported that Medium experimented with various AI detection tools but found them lacking in efficiency. Furthermore, Stubblebine alleged that Pangram Labs tried to coerce him through media pressure after Spero, the CEO of Pangram, emailed him the analysis outcomes that WIRED had sought, subsequently suggesting their services to Medium. "I believed we could be of assistance to them," stated Spero.
It's true that AI detection tools have their shortcomings. Their method involves scrutinizing texts to forecast outcomes, which can lead to incorrect affirmations or oversights. It's advisable to exercise prudence when applying these tools to assess specific examples of writing and art, particularly as new technologies emerge to outmaneuver them. Nevertheless, they serve a valuable purpose in measuring shifts in the volume of AI-created content across various platforms and sites. These tools are beneficial for researchers, reporters, and the general populace in identifying trends.
"Gillham notes that while AI detection tools are precise, they're not infallible, making it challenging to definitively determine if a specific piece of content was produced by AI. Nevertheless, he highlights their effectiveness in identifying the increasing dominance of AI-generated writing on platforms such as Medium."
The phenomenon has been observed by others as well. "In my routine searches for freshly created AI-driven news platforms, I consistently encounter content produced by AI on Medium every week," notes McKenzie Sadeghi, an editor with NewsGuard, a firm specializing in the monitoring of online misinformation. "I've noticed it predominantly covers topics like cryptocurrency, marketing, and SEO."
Stubblebine firmly believes the statistics fail to reflect the true reader experience on Medium. He argues, "It's irrelevant. Simply accessing the unfiltered stream of Medium posts doesn't show the real interaction—what's recommended and seen. Most AI-created content on these raw feeds for specific topics isn't getting any attention—it has no views. And achieving no views on such content is our aim, which our current system effectively meets." He is confident that Medium is successfully managing its AI-generated content issue through its universal spam filtering and manual moderation efforts.
Numerous profiles that seem to churn out a significant amount of content generated by artificial intelligence often have little to no following. For instance, an account identified by Pangram Labs for possibly creating AI-generated content on cryptocurrency published six times in a single day, yet none of these posts received any engagement, indicating minimal influence. Additionally, some of the content that was flagged has been taken down recently; while some removals might have been at the discretion of the poster, others were likely actioned by Medium days or weeks after they went live. According to Stubblebine, Medium sometimes intentionally delays the eradication of spam content if it is in the process of tracking down "spam rings" that are trying to manipulate the platform.
However, the situation wasn't uniformly devoid of audience engagement. WIRED discovered that several pieces identified as probable AI creations by entities such as Pangram, Originality, and the AI verification firm Reality Defender received numerous "claps" – a form of appreciation akin to "likes" on alternative platforms. This indicates a significantly larger audience than none at all.
Stubblebine views individuals as the key component in Medium's strategy for ensuring content quality. "Currently, Medium relies heavily on human selection," he mentions. He refers to the 9,000 editors working on Medium's platforms, along with further human scrutiny for articles that have the potential to be "promoted" or broadly shared. "One might argue, perhaps in a nitpicking way, that we're excluding AI-generated content—but the overarching objective is actually to weed out content that doesn't meet our quality standards."
In an effort to regulate the influx of content generated by artificial intelligence, Medium has updated its policy on AI this year. This move sets it apart from other social media giants like LinkedIn and Facebook, which actively promote the use of AI by their users. As part of its new regulations, Medium is stopping AI-generated content from being locked behind a paywall in its Partner program, being spread widely through its human-curated Boost program, or being used to push affiliate marketing links. While AI-created content that is openly acknowledged can still be distributed generally on the platform, any AI content not clearly marked as such will only be shared within the "network" distribution level. This essentially limits its visibility to the author's followers. Medium describes AI-generated content as work predominantly produced by an AI program with minimal human intervention, such as editing or fact-checking. The platform also mentioned that it does not possess tools specifically designed to enforce these new AI guidelines. According to Stubblebine, Medium has observed that its current system for curating content naturally weeds out AI-generated submissions due to their inferior quality.
Several contributors and editors on Medium have expressed their appreciation for the platform's strategy regarding artificial intelligence. Eric Pierce, the creator of Fanfare, Medium's top pop culture outlet, mentions that he rarely encounters submissions produced by AI and is of the opinion that Medium's human-led promotion program effectively showcases the platform's top human-authored content. "Over the recent months, I haven't come across any article on Medium that seemed like it could have been generated by AI," he remarks. "Medium is increasingly coming across as a refuge of rationality in an online world that seems to be on the verge of imploding."
Nevertheless, various authors and editors have expressed that they continue to encounter a significant amount of content produced by artificial intelligence on the site. Marcus Musick, a writer specializing in content marketing and editor of multiple publications, shared his concerns in a piece about a particular article he believes to have been created by AI, which gained widespread popularity. Reality Defender, after conducting a review of the said article, assessed that there's a 99 percent probability it was generated through manipulation. The article in question has received extensive attention, garnering more than 13,500 "claps."
Musick, who not only reads but also edits content, is convinced he regularly comes across work generated by AI. He estimates that he turns down about 80% of prospective writers monthly, suspecting their reliance on artificial intelligence for content creation. Rather than depending on AI detection tools, which he deems ineffective, he trusts his own discernment to identify such cases.

As part of this partnership, BandLab has committed to adhering to the principles set forth by the Human Artistry Campaign, an international group aiming to secure rights holders' involvement in how their creations are used by AI when developing its software tools. This scenario mirrors the challenges faced by the film industry, indicating that while record labels are eager to engage with the advancements in generative AI, they are equally focused on safeguarding their artists' rights and ensuring their financial stability is not compromised.

Investors are optimistic that Apple's innovative features will persuade consumers to purchase new smartphones, thereby breaking the trend of infrequent upgrades. However, this strategy faces significant hurdles in China.
Apple Intelligence is currently unable to debut in China, or Europe for that matter, due to its inability to comply with the stringent regulatory demands concerning AI in those regions. A major hurdle is its significant use of ChatGPT for certain inquiries, a service that has been prohibited in China since February 2023.
Is a resolution possible? Moreover, if it exists, does it necessitate concessions that American corporations ought to reconsider, especially when tens or hundreds of billions of dollars are at stake? Tim Cook believes otherwise.
"During a recent earnings discussion, Cook mentioned that, as one might expect, they are actively interacting with regulatory authorities in both Europe and China."
"Our goal is to proceed as quickly as possible, clearly, since our aim is consistently to deliver new features to the public. We must grasp the regulatory obligations before we can pledge to undertake this and set a timeline for its completion."
Apple's move to establish its largest research facility outside the United States in Shenzhen, China, earlier in the month, prompts inquiries. At minimum, it might be interpreted as a gesture of goodwill aimed at mending ties that became strained when the company increased its iPhone manufacturing in India earlier in the year.

"According to Neil Shah from Counterpoint Research, for a business to succeed in the era of artificial intelligence, it is crucial to focus on local model training through to inference, ensuring consideration of local context, collaborations, and compliance with regulations."
Apple faces an insurmountable challenge in this case, primarily due to the introduction of new Chinese laws.
"Foreign investment in internet-based business models continues to be regulated, allowing no more than a 50 percent stake for foreign investors," explains Michael Tan, a partner at Taylor Wessing. Tan, who has over twenty years of experience with firms working in China and its surrounding regions, emphasizes the ongoing restrictions.
"Bringing an AI feature to the market involves navigating numerous regulatory challenges, especially for American or international firms, which can be extremely challenging. Introducing Ernie from Baidu
Often regarded as China's answer to Google, Baidu operates a search engine and introduced its artificial intelligence assistant, Ernie, in 2019. Over the years, Ernie has gathered a user base exceeding 300 million and has been rebranded with a name that resonates more with Chinese culture, Wenxiaoyan.
Could the specter of Ernie linger over iPhones in China? It appears that Apple might not have a preferable option.
"Tan mentions that Amazon essentially got pushed out of the market due to their unsuccessful attempt to launch AWS (Amazon Web Services) in 2017. He points out that if you're aiming to operate it as a wholly owned Amazon enterprise, it's not feasible. Instead, forming a partnership with a local joint venture, similar to Microsoft's strategy, is necessary."
This isn't the first time Apple has faced such challenges. Starting in 2017, Chinese authorities imposed regulations that prevented Apple from using its servers to manage iCloud services for users in China, indicating a tightening grip on the tech giant.
The answer turned out to be GCBD, or Guizhou-Cloud Big Data, a firm that not only originates from China but is also owned by the government. Seven years later, it continues to manage iCloud services for Apple in China. In essence, the Chinese government oversees the emails of iPhone users in the country.
In 2021, The New York Times conducted a detailed inquiry into the adjustments Apple has made to maintain a relationship with the Chinese government. The investigation highlighted allegations such as the weakening of user data security and the deletion or restriction of apps that fail to align with the content policies of the Chinese Communist Party (CCP). It's a compelling article.
Tim Cook has openly accepted the extensive measures needed to operate within the Chinese market.
"Do you join in, or do you remain an observer, critiquing how things ought to be?" he posed the question while speaking about China at the 2017 Fortune Global Forum. "I firmly believe that you need to be present and engaged; you have to step into the fray because change never happens from the sidelines," he expressed.
Since that time, the demands placed upon Apple's compliance have increasingly become more burdensome. The Chinese government requires that algorithms, which dictate the online content accessible to the public or those driven by artificial intelligence, must be officially registered. Additionally, recent AI laws are primarily aimed at regulating the specific types of public-facing models that Western technology firms are keen on engaging with.
"Tan mentions that it's necessary to submit filings to regulatory bodies. This could involve providing extensive information about aspects such as coding, a requirement that many technology firms might be hesitant to fulfill."
The issue lies in the fact that China has the capacity to implement these strategies because it currently holds a more significant advantage in terms of power dynamics than it has in the past.
"China has moved beyond merely trailing in numerous technological sectors," Tan notes. "It is now progressing and assuming a dominant position."
Keeping the Status Quo?
Through the lens of the West, China's regulations for generative AI range from commendable to concerning.
The policy encompasses various ambiguous restrictions related to censorship, stipulating that content created through deep synthesis must "align with the appropriate political orientation," avoid "disrupting the economic and social stability," and must not be utilized to produce false news, according to the analysis by Carnegie Endowment on the situation in 2023.
The term "deep synthesis" is used by the CAC as a substitute for generative AI. Under China's regulations, a version of Siri would be created that avoids discussing the Dalai Lama, does not recognize Taiwan as an independent nation, and omits mention of the Uyghurs, among potentially other limitations.
Considering the relaxed oversight on Western Large Language Models (LLMs), it's challenging to imagine a chatbot that wouldn't be persuaded to declare that China is under Taiwan's sovereignty, or to consistently comply without fail. However, numerous Chinese tech firms have successfully conformed to the guidelines, at least to the regulators' contentment. In August 2024, the South China Morning Post noted that 188 LLMs had received approval for deployment, a significant increase from only 14 in January 2024.
One might say that Apple's decision to implement a tailored version of these Large Language Models (LLMs) for the Chinese iteration of Apple Intelligence is simply par for the course. The tech giant has a history of modifying its app store to align with Chinese regulations, and it has consistently worked alongside local partners.
Yet, as Apple Intelligence's generative AI becomes central to iPhones and other gadgets, there's a growing concern that the firm, as a US entity, may be perceived as overly accommodating to the demands and preferences of the Chinese government.
In August, the head of China's Cyberspace Administration, Zhuang Rongwen, highlighted the significant impact of generative AI, including chatbots, on economic and social development. A 2021 article by The New York Times indicated that the Chinese government might not rely heavily on data from Chinese users of iPhones for surveillance purposes, given its access to more robust means. However, through advancements in generative AI, Apple could unknowingly play a bigger role in supporting the objectives of the Chinese Communist Party.

Today, Liquid AI, an innovative startup originating from MIT, is set to unveil a series of advanced AI models. These models are built on an innovative "liquid" neural network architecture, which promises enhanced efficiency, reduced energy consumption, and greater transparency compared to traditional neural networks that drive a wide range of applications, from chatbots and image creation tools to facial recognition technologies.
Liquid AI has introduced several innovative models, including tools for identifying fraudulent activities in financial dealings, managing autonomous vehicles, and examining genetic information. At a presentation at MIT, the firm showcased these models, which are available for licensing by other businesses. Financial backing for the company comes from several investors, among them Samsung and Shopify, both of which are currently evaluating its technologies.
"Liquid AI is expanding," declares Ramin Hasani, the company's cofounder and chief executive officer, who initially developed the concept of liquid networks during his time as a graduate student at MIT. The genesis of Hasani's work was the behavior and structure of the C. elegans, a tiny worm commonly found in decaying plant matter or soil. This organism is notable for being one of the select few whose entire nervous system has been completely mapped, displaying an impressive range of behaviors despite having a mere few hundred neurons. "What began as an academic endeavor has now fully transitioned into a commercially viable technology, poised to deliver significant benefits to businesses," explains Hasani.
In a typical neural network, every artificial neuron's characteristics are determined by a fixed numerical value or "weight" that influences its activation. However, in a liquid neural network, the activity of each neuron is dictated by a formula that forecasts its actions through time, and as the network operates, it calculates a series of interconnected equations. This architecture renders the network both more adaptable and efficient, enabling it to continue learning beyond the initial training phase, in contrast to traditional neural networks. Furthermore, liquid neural networks offer a level of transparency not found in current models, as their functioning can essentially be traced backward to understand the process leading to a specific outcome.
In 2020, a team of scientists demonstrated that a notably compact network, comprised of merely 19 neurons and 253 synapses, was capable of operating a simulated autonomous vehicle. This is significantly minimal compared to contemporary norms. Unlike conventional neural networks that process visual data in discrete moments, this fluid network adeptly tracks the dynamic evolution of visual inputs. By 2022, the creators behind Liquid AI discovered an efficient method that significantly reduced the computational effort required for liquid neural networks, making them viable for real-world applications.
Liquid AI claims to have advanced its research, creating innovative models that it currently chooses to withhold from public disclosure. This September, the firm showcased several expansive language models derived from its unique network architecture. According to the startup, one iteration of its language model, which boasts 40 billion parameters, surpassed the performance of Meta's 70-billion-parameter Llama 3.1 model on a widely recognized suite of problems referred to as MMLU-Pro.
"The performance benchmarks for their Spatial Light Modulators (SLMs) appear to be quite encouraging," remarks Sébastien Bubeck, a researcher from OpenAI dedicated to investigating the impact of architecture and training on the efficiency of AI models.
"Discovering a novel foundation model is a rare occurrence," states Tom Preston-Werner, GitHub's cofounder and an initial investor in Liquid AI. He observes that the transformer models, which serve as the basis for large language models and various AI technologies, are beginning to reveal their constraints. Preston-Werner emphasizes the importance of enhancing AI's efficiency as a major goal for all. "It's crucial that we exert every effort to avoid prolonging the operation of coal plants," he remarks.
A limitation of Liquid AI's methodology is its networks' predisposition towards specific assignments, notably those dealing with time-sensitive information. Adapting the system to handle different data formats necessitates specialized programming. Additionally, convincing major corporations to rely on an entirely novel AI framework for critical initiatives poses a significant hurdle.
Hasani emphasizes that the current objective is to show that the advantages, such as improved efficiency, greater transparency, and reduced energy expenses, surpass the obstacles. "We're reaching phases where these frameworks can significantly reduce many of the social and technical difficulties associated with AI systems," he notes.

Google, Microsoft, and Perplexity Accused of Facilitating Racist Ideologies Through Search Outcomes
Artificial intelligence-powered search platforms by Google, Microsoft, and Perplexity are under scrutiny for displaying search results that propagate racist theories and discredited studies suggesting genetic supremacy of white individuals over those of other races.
Patrik Hermansson, an investigator affiliated with the British anti-discrimination organization Hope Not Hate, found himself deep into an extended probe into the revival of race science theories. During this period, he sought further details about a discredited dataset arguing that IQ tests could demonstrate the supremacy of the white race.
He was conducting an inquiry into the Human Diversity Foundation, a firm focused on racial science, which received financial backing from Andrew Conru, an American technology mogul known for creating Adult Friend Finder. This organization, established in 2022, served as the modern iteration of the Pioneer Fund, an entity initiated in 1937 by American supporters of Nazi ideology, dedicated to advancing concepts of "racial improvement" and "racial realism."
Hermansson accessed Google and started searching for the intelligence quotients (IQs) of various countries. Upon entering "Pakistan IQ" into the search bar, instead of seeing the usual array of search results, Hermansson encountered Google's AI-driven Overviews feature, which was unexpectedly activated as the default setting. This tool provided him with a clear response of 80.
Upon entering "Sierra Leone IQ" into Google's AI feature, it provided a precise figure: 45.07. Similarly, the search for "Kenya IQ" yielded an equally precise number: 75.2.
Hermansson instantly realized that the figures being relayed to him were sourced directly from the very research he aimed to discredit, authored by a prominent figure of the movement he sought to reveal.
The information provided by Google originated from a dataset released by Richard Lynn, a professor at the University of Ulster who passed away in 2023 and served as the president of the Pioneer Fund for twenty years.
"Hermansson describes his impact as colossal. He remained a central figure and the beacon of inspiration for the movement until his passing. Right up until his final moments, he played a pivotal role in leading it," Hermansson states.
An investigation by WIRED corroborated the observations made by Hermansson and revealed that additional AI-powered search engines, including Microsoft’s Copilot and Perplexity, reference Lynn’s studies in response to inquiries about national IQ scores. Lynn’s controversial research, which has been a staple among far-right radicals, white supremacists, and eugenics advocates to argue for the genetic and intellectual superiority of white people over non-white individuals, is now raising concerns among experts. They fear that AI's dissemination of these ideas could contribute to the radicalization of more people.
"Blindly accepting these 'statistics' poses significant issues," says Rebecca Sear, who heads the Center for Culture and Evolution at Brunel University London, in a conversation with WIRED. "Therefore, employing these figures does more than just distribute false information; it also supports the agenda of scientific racism, which is the wrongful application of science to argue that racial hierarchies and disparities are normal and unchangeable."
Supporting her argument, Sear highlighted that the white supremacist responsible for the 2022 mass shooting in Buffalo, New York, referenced Lynn’s studies in his actions.
Earlier in the year, Google introduced AI Overviews, a new feature aimed at enhancing its dominant search engine to adapt to the rapidly changing digital landscape influenced by artificial intelligence. This feature, currently accessible only in select nations, offers users an AI-crafted synopsis for various search inquiries. It aggregates data from across the web, providing answers directly to users, eliminating the need to visit any external websites.
The summary provided by AI Overview initially lacked direct attribution to its sources, leading to user dissatisfaction due to the absence of visible article references. Responding to this feedback, Google has now incorporated a feature that displays the title of a source next to the AI-generated summary. Since its introduction in May, AI Overviews have encountered several problems, prompting Google to acknowledge the mishandling of its much-anticipated debut. By default, AI Overviews are active in search results and cannot be disabled without resorting to the use of third-party plugins. Hermansson, a researcher, shared with WIRED, "It was activated on its own; I didn't turn it on. I'm not sure how it got activated."
Regarding the intelligence quotient (IQ) findings, Google cited numerous references, such as content on X, Facebook, and several lesser-known listicle platforms, among them World Population Review. Almost without exception, tracing the origins of these sources reveals they all point to the controversial dataset compiled by Lynn. (In certain instances, although the specific figures Lynn reported are mentioned, the websites fail to acknowledge Lynn as their origin.)
When asking Google’s Gemini AI chatbot the same question, it offered a more detailed answer. “One should be careful when engaging in conversations about national IQ scores,” was the chatbot’s reply to the question “Pakistan IQ.” The response went on to say: “IQ tests are mainly developed for Western cultures and may not fairly assess people from various backgrounds.”
Google informed WIRED that its systems did not function properly in this instance and is exploring options to enhance them.
"Google has implemented safeguards and rules to prevent subpar responses, and we promptly address any Overviews that breach our guidelines," Ned Adriance, a spokesperson for Google, informed WIRED. "The Overviews in question breached our guidelines and have been eliminated. We aim for AI Overviews to link to superior content, enabling users to delve deeper, although it's acknowledged that high-quality web content may be scarce for certain queries."
WIRED's investigations indicate that although AI Overviews for inquiries regarding national IQs seem to have been disabled, the outcomes continue to highlight inaccurate data from Lynn's studies through what is known as a "featured snippet," – a section that showcases a portion of text from a website above its link.
Google remained silent when asked to comment on the new update.
However, Google isn't the only one spreading these hazardous ideas. Upon conducting the same search with other AI-driven internet search platforms, WIRED discovered comparable outcomes.
Perplexity, a company specializing in AI search technology known for generating content spontaneously, replied to a question regarding "Pakistan IQ" by indicating that "there are considerable differences in reported average IQ levels in Pakistan, depending on the information source."
Subsequently, it enumerates several references, among them a discussion on Reddit that utilized the studies conducted by Lynn and the identical World Population Review webpage that was mentioned in Google’s AI Summary. In response to an inquiry regarding the IQ average in Sierra Leone, the Perplexity specifically quoted Lynn’s data, stating: “The average IQ in Sierra Leone is documented as 45.07, placing it amongst the lowest worldwide.”
Perplexity remained silent when asked for their opinion.
Microsoft's Bing search engine features a chatbot named Copilot that confidently stated, "The average IQ in Pakistan is estimated to be about 80," attributing this information to a site named IQ International, which lacks citation for its data. In response to a query about "Sierra Leone IQ," Copilot indicated that it was 91, directing users to a site named Brainstats.com that cites the studies of Lynn. Additionally, when asked about the IQ level in Kenya, Copilot again pointed to information from Brainstats.com.
"Copilot generates responses by synthesizing data from various online platforms into one coherent answer," Microsoft representative Caitlin Roulston explains to WIRED. “Copilot includes referenced links allowing users to delve deeper and conduct their own investigations, similar to how they would utilize a conventional search engine.”
Google mentioned that one challenge it encounters in creating AI Summaries is the lack of high-quality content on the web for certain niche topics. It's clear that the work of Lynn does not fall into this category of high quality.
Sear pointed out that the scientific foundation of Lynn's 'national IQs' database is so flawed that it's hard to see it as anything other than deceitful. He highlighted that Lynn has failed to explain how he chose the samples for the database, and that the IQ estimates for many countries are based on laughably small and unrepresentative samples.
Sear highlights that Lynn's calculation of Angola's IQ is derived from data on merely 19 individuals, and his assessment of Eritrea's IQ comes from studies on children residing in orphanages.
"Rutherford criticized the foundation of the dataset created by Lynn, highlighting its lack of credibility and flaws on several levels," he explained, noting that the data point for Somalia in Lynn's collection was derived from a singular group of refugee children, ages 8 to 18, assessed in a refugee camp in Kenya. Furthermore, he mentioned that the figure for Botswana was obtained from an isolated group of 104 Tswana-speaking high school students, ranging in age from 7 to 20, who underwent testing in English.
Opponents of employing national IQ assessments to advance notions of racial superiority highlight that the samples gathered are often of poor quality. Additionally, they argue that these tests are fundamentally skewed as they are primarily devised for Western populations, thus introducing bias from the outset.
Sears pointed out that findings suggest Lynn deliberately skewed the database by selectively incorporating instances of low IQs and omitting those with high IQs from African countries, a claim supported by a preliminary study released in 2020.
Over several decades, Lynn released multiple editions of his dataset on global IQ levels, with his latest edition titled “The Intelligence of Nations” coming out in 2019. Throughout this period, Lynn's controversial research has been cited by extremist and racially biased organizations to support assertions of Caucasian supremacy. Additionally, the information was transformed into a global map with colors, depicting countries in sub-Saharan Africa in red to indicate supposedly lower IQ levels, while Western countries were marked in blue.
"Rutherford points out that this type of data visualization is commonly found across [X, previously referred to as Twitter], and throughout social media platforms. He mentions that in online spaces frequented by racists, this is often presented as evidence to support their arguments, with a directive to 'Examine the data. Observe the map.'"
However, Rutherford argues that responsibility should not be placed solely on AI technologies but also on the scientific community, which has for years accepted and referenced Lynn’s research without sufficient scrutiny.
"Rutherford pointed out that it's hardly shocking to see AI systems referencing Lynn's contributions to the field of IQ, given the widespread acceptance his research has garnered across vast segments of the academic community. He highlighted that Lynn's databases on national IQ scores have been referenced in academic literature hundreds of times. Therefore, according to Rutherford, the blame should not be placed on AI technology but rather on the academic institutions that have uncritically embraced Lynn's findings."

Anthropic Aims for Its AI to Operate Your PC

During a subsequent demonstration, Claude was tasked with creating a basic website for self-promotion. In an almost dreamlike scenario, the AI model utilized its own interface to input a command, triggering the generation of the required code. Following this, it employed Visual Studio Code, a widely-used programming editor from Microsoft, to construct a straightforward website. It then proceeded to launch a text terminal to initiate a basic web server for the site's testing. The outcome was a fairly good website with a retro, 1990s vibe as its landing page. When prompted to rectify an issue on the website, Claude revisited the code editor, pinpointed the problematic code segment, and removed it.
Anthropic's Chief Product Officer, Mike Krieger, expresses the company's aspiration for AI assistants to handle mundane administrative duties, allowing individuals to focus on more creative pursuits. “Imagine eliminating several hours spent on repetitive tasks like copying and pasting. What would you do with that extra time?” he muses. “For me, it would mean more time for playing guitar.”
Starting today, Anthropic is offering access to the advanced capabilities of its most sophisticated multimodal large language model, Claude 3.5 Sonnet, via its application programming interface (API). Additionally, the firm unveiled an upgraded iteration of a more compact model, Claude 3.5 Haiku, today.
Showcases of artificial intelligence (AI) systems often impress audiences, yet ensuring these technologies operate smoothly and without significant (or expensive) mistakes in practical applications remains difficult. Present-day versions are capable of responding to inquiries and engaging in dialogue with a level of proficiency that closely resembles human interaction. They serve as the foundation for chatbots like ChatGPT from OpenAI and Gemini from Google. Furthermore, these systems are adept at executing computer-based tasks upon receiving straightforward instructions, by either interacting with the computer's display and input devices such as keyboards and trackpads, or via direct software interfaces.
Anthropic reports that its AI system, Claude, surpasses other AI models in various critical evaluations, among them SWE-bench, a benchmark assessing the software engineering prowess of an agent, and OSWorld, a test measuring an agent's proficiency in navigating and utilizing a computer OS. These assertions, however, await confirmation from independent sources. According to Anthropic, Claude achieves a success rate of 14.9 percent in correctly executing tasks within OSWorld. Although this performance is significantly below the average human success rate of about 75 percent, it is notably better than the performance of the leading competitors, including OpenAI's GPT-4, which has a success rate of approximately 7.7 percent.
Anthropic reports that numerous firms are currently experimenting with the agentic iteration of Claude. This encompasses Canva, employing it for design and editing automation, and Replit, which utilizes the model to assist with programming tasks. Additional initial adopters comprise The Browser Company, Asana, and Notion.
Ofir Press, who is conducting postdoctoral research at Princeton University and contributed to creating SWE-bench, points out that AI with agency often falls short in long-term planning and frequently has difficulty correcting its mistakes. He emphasizes the importance of demonstrating their utility by achieving robust results in challenging and practical tests. For instance, he mentions the significance of the AI's ability to consistently organize various travel plans for a user and handle all the associated ticket reservations.
Kaplan points out Claude's impressive ability to rectify certain mistakes quite adeptly. For example, when encountering a critical failure during the launch of a web server, the model skillfully altered its command to rectify the issue. Additionally, it figured out the necessity of allowing popups to overcome obstacles while navigating the internet.
Numerous technology firms are currently in a competitive rush to create artificial intelligence tools, aiming to secure a larger portion of the market and gain significant recognition. Indeed, the time may soon arrive when numerous individuals will have access to these AI tools readily. Microsoft has invested over $13 billion in OpenAI and is currently experimenting with tools that are capable of operating Windows computers. Meanwhile, Amazon, having made substantial investments in Anthropic, is investigating the potential for these tools to suggest and, in the future, directly purchase items for its consumers.
Sonya Huang, a Sequoia venture firm partner with a focus on AI enterprises, mentioned that despite the hype surrounding AI agents, the majority of businesses are essentially just giving AI-enhanced tools a new name. In a conversation with WIRED prior to the announcement from Anthropic, she shared her insight that the technology presently excels in specific areas, like tasks related to programming. "It's essential to select areas where it's acceptable for the model to make mistakes," she notes. "These are the areas where companies genuinely dedicated to agent-based solutions will emerge."
One of the major difficulties in managing advanced AI is that mistakes can have much more serious consequences than a confused chatbot response. To mitigate these issues, Anthropic has set specific limitations on Claude's capabilities, such as restricting its power to make purchases using an individual's credit card.
Press from Princeton University believes that if mistakes can be sufficiently prevented, users may begin to perceive AI and computers from an entirely fresh perspective. "I'm extremely enthusiastic about this forthcoming period," he states.

Legal Action Targets Perplexity for Artificially Generated Misinformation
A recent legal challenge against the emerging company Perplexity alleges that it not only infringes copyright regulations but also breaches trademark laws by fabricating parts of news articles and inaccurately crediting these fabrications to established publishers.
Today, Dow Jones, the company behind The Wall Street Journal, and the New York Post, both subsidiaries of Rupert Murdoch's News Corp, filed a copyright infringement case against Perplexity in the Southern District of New York, USA.
Perplexity has previously encountered issues with news organizations. Just a few weeks ago, The New York Times issued a formal notice to Perplexity, accusing it of unauthorized use of its content. Over the summer, investigations by Forbes and WIRED revealed instances where Perplexity seemed to have copied articles. Following these findings, Condé Nast, the parent company of both Forbes and WIRED, also dispatched formal warnings to Perplexity.
An investigation conducted by WIRED this past summer, which this legal action references, revealed how Perplexity provided incorrect summaries of WIRED's articles. This included a specific case where Perplexity erroneously stated that WIRED covered a story about a police officer in California being involved in a criminal act he was actually innocent of. Earlier today, The Wall Street Journal reported that Perplexity is aiming to secure $500 million in its upcoming round of financing, targeting a valuation of $8 billion.
Dow Jones and the New York Post have highlighted instances where Perplexity, an AI system, reportedly generated completely made-up parts within news articles. In the context of artificial intelligence, "hallucination" refers to the phenomenon where AI models create and output information that is entirely false, treating it as true.
In a highlighted instance, Perplexity Pro initially replicated exactly two sections from an article by the New York Post discussing a disagreement between US senator Jim Jordan and European Union commissioner Thierry Breton regarding Elon Musk and X. Subsequently, it added five original paragraphs discussing the concepts of free speech and internet governance, which were absent in the original publication.
The legal action alleges that incorporating these fabricated sections into genuine journalism and falsely associating them with the Post constitutes trademark dilution, potentially misleading readers. "Confusion's illusions, presented as legitimate news and content from credible sources (under the guise of Plaintiffs’ trademarks), undermine the worth of Plaintiffs' trademarks by introducing doubt and skepticism into the process of news collection and dissemination, in addition to injuring the news-reading audience," the lawsuit asserts.
Perplexity remained silent when approached for a statement.
In an email to WIRED, Robert Thomson, the CEO of News Corp, made a less than favorable comparison between Perplexity and OpenAI. He praised OpenAI for their commitment to integrity and creativity, highlighting these as crucial for fulfilling the promise of Artificial Intelligence. "Unlike Perplexity, which isn't alone in misusing intellectual property, it won't be the last AI firm we actively and meticulously confront," Thomson’s statement read. "Although our preference leans towards engagement over litigation, the protection of our journalists, authors, and the corporation compels us to stand against this theft of content."
OpenAI is currently embroiled in a legal battle over claims of trademark dilution. In a case titled New York Times v. OpenAI, the newspaper accuses OpenAI and its partner Microsoft of tarnishing its image. Specifically, the Times contends that ChatGPT and Bing Chat misattribute fabricated statements to the publication. One instance highlighted in the lawsuit involves Bing Chat incorrectly stating that the Times endorsed red wine, in moderation, as beneficial for heart health, a claim the newspaper asserts it has actually refuted in its reporting.
"Using news articles to run alternative, profit-driven AI services is illegal, a point we emphasized through our correspondence with Perplexity and our legal actions against Microsoft and OpenAI," states Charlie Stadtlander, the New York Times' director of external communications. "We commend the legal action taken by Dow Jones and the New York Post, viewing it as a crucial move in safeguarding publisher materials from such unauthorized use."
Several legal authorities are questioning the effectiveness of pursuing charges related to false designation of origin and trademark dilution. Intellectual property attorney Vincent Allen, a partner with Carstens, Allen & Gourley, is of the opinion that the copyright infringement allegations present in this case are more substantial. He would be "surprised" if the charge concerning false designation of origin is upheld. Allen, along with James Grimmelmann, a digital and internet law professor at Cornell University, points to the significant Dastar v. Twentieth Century Fox Film Corp. case as a potential obstacle. This case, which dealt with a controversy surrounding historical World War II footage, led the Supreme Court to determine that "origin" in trademark law does not cover the authorship but rather is confined to physical items—such as counterfeit merchandise—instead of pirated creative content like movies. Moreover, Grimmelmann expresses doubts about the success of the trademark dilution argument, explaining, "Dilution refers to using a trademark in a manner that diminishes the uniqueness of a well-known mark. I … simply don't see it happening in this instance."
Should publishers succeed in their case that hallucinations can infringe upon trademark rights, AI firms might encounter "significant challenges," says Matthew Sag, who specializes in law and artificial intelligence at Emory University.
"Sag believes that ensuring a language model never produces fabricated content is utterly unfeasible. He argues that due to their design, which involves generating words that seem appropriate in response to given cues, language models are inherently engaged in a form of making things up—though, at times, the results can appear more believable than at other times."
"We label it as a hallucination only when it conflicts with our perception of reality, yet the mechanism behind it remains identical, regardless of whether we approve of the result or not."
